New Jersey Dog Bite Statute
New Jersey’s dog bite statute is a “strict liability” statute. This means that a dog’s owner is liable for any dog bite injuries that occur so long as the person bit is in a private place or lawfully in a public place. The dog does not need to possess any prior indications of viciousness nor does the owner need any knowledge of any former viciousness.
It does not matter if the owner used reasonable care to restrain the dog or tried to protect or warn others. The owner of the dog does not need to be careless or negligent. All that a victim needs to prove is that the bite occurred.
The dog bite statute does not cover injuries caused by dogs in any way other than biting. Any injuries sustained from a running, jumping, or out-of-control animal does not fall under the dog bite statute.
One of the only possible defenses to a dog bite claim is that the dog bite victim was trespassing when the incident occurred. People carrying out official duties, such as mail carriers delivering mail, are considered to be “lawfully” on private property for the purposes of the law. However, a trespasser is not “lawfully” on the property, and so the statute may not apply.
